ゴビンダ医師の市民的抵抗，医学部長解任事件最高裁判決に対して(4)

５．「５項目合意」とハンスト終了
最高裁法廷（P・バンダリ判事とBK・シュレスタ判事）は１月１０日，ゴビンダ医師の陳述聴取後，保釈金なしで彼を保釈した。一方，パラジュリ最高裁長官については，市民登録証とSLC資格の調査を命令した。ゴビンダ医師の次の出廷は，２月２０日の予定。

保釈後，ゴビンダ医師は政府側（D・ボハラ保健大臣ほか）と交渉，１月１２日夜，合意に達し，両者は「５項目合意」に署名した。

▼５項目合意（１月１２日）
(1)「医学教育委員会」を組織するための準備委員会を7日以内に設立。
(2)JP・アグラワル医師はトリブバン大学（TU）医学部長の職にそのまま留まる。
(3)TU医学部に権限を戻すために必要なTU役員会を開催。
(4)TU教育病院改革に必要な予算の計上。
(5)ゴビンダ医師のハンスト終了。

この10日の最高裁決定と12日の「5項目合意」をみると，パラジュリ最高裁長官の辞任ないし解任については何も述べていないが，他の重要な点ではゴビンダ医師の要求が大幅に認められていることがわかる。自らの命をかけハンストで抗議したゴビンダ医師の「市民的抵抗」の勝利といってよいだろう。

しかしながら，ネパールでは，ここからが難しい。合意が成立しても，それが誠実に実行されない場合が少なくないからだ。ゴビンダ医師も，パラジュリ長官が辞任しなければハンストを再開する，と警告している。近く発足するであろう左派連合政府が，この問題とどう取り組むか，注目されるところである。
